Terms of Service

These Terms of Service (“Terms”) govern access to the tajapps.com website and to the Privara product and related services provided by TAJ APPS LLC (“TajApps”, “we”). By using the site or the services, you agree to these Terms. A signed order or license agreement, where one exists, prevails over these Terms.

1. Who may use the services

Privara is a business-to-business product for organizations, not consumers. Access requires organizational KYC verification. You confirm you are authorized to act for your organization and that your use will comply with our Acceptable Use Policy and all applicable laws.

2. Licenses

Privara is licensed, not sold. Subject to a separate signed, time-boxed license and to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Privara for the number of concurrent devices and the scope stated in that license — either self-hosted (you run the image on your own KVM infrastructure) or hosted (we run the infrastructure for you). You may not sublicense, resell, reverse-engineer, or circumvent licensing controls except to the extent the law does not allow that restriction.

3. Acceptable use

Your use is governed by our Acceptable Use Policy, which is incorporated into these Terms. Breaching it is a material breach of these Terms.

4. Fees & billing

Licensing is priced per concurrent device per month, with volume tiers and an annual-prepay discount; self-hosted fees are for the license only and your compute is separate. Professional services (for example, detection audits and resilience assessments) are scoped and quoted per engagement. Published prices are indicative; the applicable order or quote controls. Fees are exclusive of taxes.

5. Intellectual property

Privara, the TajApps software, and all related intellectual property are and remain owned by TAJ APPS LLC. You receive only the license expressly granted. If you send us feedback, you grant us a perpetual, royalty-free license to use it. Third-party names and trademarks referenced on our site belong to their owners and are used for comparison only.

6. Confidentiality

Non-public information exchanged between the parties is confidential and, where a mutual non-disclosure agreement is in place, is governed by that agreement.

7. Warranties & disclaimer

The services are provided for testing, QA, security research, and demonstration purposes “as is” and “as available”, without warranties of any kind to the maximum extent permitted by law. We do not warrant that Privara will defeat, or fail to defeat, any particular third-party control, or that it is fit for any use that would violate the AUP or any law. You are responsible for using the services lawfully and within your authorization.

8. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data; and our total liability arising out of or relating to the services will not exceed the fees you paid us for the services in the twelve months before the event giving rise to the claim.

9. Indemnification

You will defend and indemnify TAJ APPS LLC against claims, losses, and expenses arising from your use of the services in breach of these Terms, the AUP, or applicable law.

10. Term & termination

We may suspend or terminate access for breach of these Terms or the AUP, or as set out in your license. On termination, your right to use the services ends and you must stop using and, where applicable, remove the software.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to conflict-of-laws rules, and the parties submit to the courts located there, unless a signed agreement states otherwise.
